Why was Scott Peterson convicted of 2 murders? (Read 1,796 times)

Why was Scott Peterson convicted of 2 murders?

He killed his pregnant wife and was convicted for two counts of murder, one for the wife, and one for the unborn child. Why is that? If a person is only a living person after birth, shouldn't he have been only convicted for killing his wife?

Half the states in the country have what are called "fetal homicide" laws which allow prosecutors to seek a double murder charge when a pregnant woman is killed, including California.

I believe the "viability" or "personhood" point of your question only applies to an issue of abortion rights, which this had nothing to do with, as the child was desired to be born by his mother. There's no legal correlation with Roe v Wade here. I'm not sure at which point in the pregnancy this statute kicks in, but Laci Peterson was 8 months pregnant and her baby surely was viable and would have lived if not trapped in her body once Scott murdered her, thus he's guilty of murdering the baby too.

Are you just trying to understand why, or do you have a problem with that?

From what I've heard, it is because when a woman has the intention of keeping the baby it is considered murder for someone to take the babys life without her permission....

Peterson was in Massachusetts. California law would have no relevance.

wow... i'd like to see a legal explanation of that!

or how about a scientific one.
