When a cop asks your name or for an ID, show it.

Capt. O. suggested that you can be arrested for refusing to speak to a copper.

They can detain you. If they feel like being an asshole.

In some states failure to show an ID when requested can lead to an arrest but that is far different then being asked to incriminate yourself.

What states? What if you don't have an ID on you?

Capt. O didn't say that.

Yeah, I do. And I am smart enough to show Id and answer a few questions so I stay free. Only a moron or a criminal trying to hide something would not talk and answer questions. Looks like we have some morons posting here. Now put your hands behind your back, cuffing you for my safety, you are not under arrest, do you have any weapons on you, stand still while I frisk you. Don’t move moron. Oh, what is this, marijuana? Oh oh.

It sure does not look good for the shooter. If he was able to leave and get a gun, he should have just called 911. The man stayed in the shower, so it seems, was no threat. I know the law very well Capt. Bull shit champion.

Roll Eyes

The Second Amendment or even the "Castle Doctrine" doesn't grant anyone the authority to murder people on their property.

You have a right to remain silent if you are being accused of a crime. When a cop asks your name or for an ID, show it. Otherwise you become a suspect. That could lead to more unpleasantness until he finds out if there is a warrant out for you.

An officer can slap handcuffs on you, tell you to sit down on the curb and call it a "detainment." Now forgive me for not going to law school, but to the average Joe, that feels a hell of a lot like being arrested.  So if you refuse to speak at this point, the officer can simply make an arrest.  Need I remind you the booking procedure is no joke and can eat up the better part of your day.   Angry

It's rather inconvenient really.

The cop will always tell you when you are under arrest. And they will read you your rights. If they don’t and ask you questions, anything you say might not be able to be used in court.
Cops are well trained. Of the great number in the country, it is very few that are fu*& ups. I have friends that are police, I have family on my wife’s side that are cops, and one FBI. One is a motorcycle cop. His brother is a cop too, and had his own motorcycle. He didn’t ride much, don’t know if he still has one. Never thought about it till now. He is not a motorcycle cop. Both good guys.
