That is not the point.  The point is you have to be in control of when you speak or do not speak to the police.  You also have to understand that unless you are in custody they do not have to Mirandize you and anything you say during that time can be used against you.

For example if you are brought in for questioning concerning an event you may be involved in, a common approach is to ask you to come in to assist in an investigation.  If you come down voluntarily and answer questions, even if they are incriminating, before being Mirandized, those answers will be admissible. 

Also, the other point is that you not only have to know when to not answer but HOW to not answer.  You do not have to be a belligerent idiot about it.

it's really quite simple no one should EVER talk with law enforcement w/o a lawyer.

Good point.  I wouldn't put it past the NBA either.  But let's be reasonable here.  It was probably the NRA or at least the NFL.  Gun humpers all of them.

Essentially you're correct, it's conjecture and opinion.  It's kind of my thing.  I tend to share my opinions with others about stuff.  It's part of the human condition, posting on political forums and sharing thoughts.

It's logical to assume the shooter is going to pursue a self defense case seeing as he called the cops just after the shooting.  He thought he was in the clear and assuming it was from reading too much or not enough of the NRA pamphlet.

If the shooter was an NRA member or knew anything about the self-defense laws he would not be in trouble. He seems to be about as bright as you or Fiddler.

Archie is a wonderful example though!

I also don't care to limit anyones rights to firearms. I've at times argued for stricter licensing, but never a ban.  I don't bother anymore and concede that it's just American condition to grow up with unabated gun violence, I'm a fatalist in that regard.

It's likely correct.  If he had just read a little, he might be under the impression he can shoot to kill if he finds an intruder on his property or perhaps he read too much and lost the fact that he must prove his life was actually endanger.

There should be a standardized and proven way to educate people on gun fondling.  Or not, kind of don't really care anymore.  Guns for all!
