If the Constitution were written today...

Tonight Mark Levin brought up an interesting topic. He said that if the Constitution were scrapped, and our Congress had to create a new Constitution, the new version would be very different from our Founding Fathers' original document.

Do you agree? If so, what would be the biggest differences?

The President would have far more power.

The enumerated powers of the federal government would be completely done away with.  Same with many of the bill of rights especially regarding states rights.

Rather than rights to -pursue-, rights to -have- would be guaranteed.

Basically everything would be much more centralized and it would be pointless to even acknowledge state boundaries as real entities.  States would more likely become more like Congressional districts.  Redrawn by who is in charge.  Same with county and local administration.

Everything centralized from above.

The idea of a Senate and House would be pointless and redundant.  It'd be merely one branch that simply provides the image of democracy.

It would be very different but the outcome would literally be an elected dictator, a judicial branch that's more like an oracle, and a legislative branch that adheres to whatever the dictator wants or says.

Essentially we'd be like Russia.

The constitution and politicians are only as good as the citizenry

Which is why Levin should be careful when he calls for a Constitutional Convention. Watch what you wish for you might get it...and regret it.

You are correct!  Obama expressed openly the argument against our Constitution that so many on the Left have  Our Founders (correctly) were distrustful of a large centralized powerful government and wrote our Constitution to purposefully limit the scope and power of the government.  Originalists want to preserve this view  Those on the Left who see the Constitution as being so flawed that it needs to be considered as "a living document: subject to  CHANGE  outside of the Constitutional method of the Amendment process.  The Left truly BELIEVE that Elites would rule over the masses who are too ignorant and stupid to even know what's best for them AND THAT DAMN CONSTITUTION STANDS IN THEIR WAY!  (The Left use sections from the Constitution when it is to their advantage, while actively trying to circumvent it when it doesn't! They HOPE people will forget what the Constitution ever meant and that they can alter it's meaning just as they have done with "separation of church and state" which is not even mentioned anywhere in the COnstitution, it was mentioned in a private letter from Thomas Jefferson, but the meaning then was clearly not as it has come to be used today)

Of course it would be.  Our political leaders are influenced by ignorant people.  Unlike the founding fathers.  Nothing could replace what we have.

I don't think he does it to sell book. His latest book debuted at # 1 before it was even actually in the stores.

He believes it will work and even he points out the pitfalls of calling for a CC.

The "watch what you wish for"...was my opinion. Does he expect that liberals and RINOs are going to correct what is wrong in this country?

That's where I think he's naive but he's far more informed on this issue than me and likely anyone being that he is a Constitutional attorney.
