That would be since the UK Constitution Reform Act of 2005. Prior to that, the Lord Chancellor, appointed by the Queen on the advice of the PM, combined executive, legislative, and judicial functions in one office, and this could be overtly political, since the LC could elevate jurists of his choosing for consideration for high court appointments. Since 2005, the LC only supervises the process, and must accept the nominations of an independent committee.



Actually, the 2005 changes were an attempt to curtail the independence of the courts, roundly destroyed by the independent judiciary.


That’s the beauty of an unwritten Constitution:

  It’s possible for good people to do good things outside the unwritten rules that permit bad people to do bad things.

It would be my guess, however, that most British judges lean conservative, by dint of the social classes from which they usually originate ("the one requirement is that they be gentlemen").

Here in the states a lot of local judges - even state supreme court judges - are elected on a general ballot. In effect what this usually turns out, at least on the local level, is that the judges who win elections are the ones that the police union likes. That's because the police unions know exactly which judges have ruled in their favor, and they have the organization to ensure a good turnout for the anointed. Most citizens (including myself) generally have no idea who the nominees are or how they might lean.

Hmmm maybe. We have a healthy iconoclastic and contrary tradition, mingled with a respect for and love of tradition, which makes judges hard to pin down.


There aren’t any celebrity judges.

Courts often drive Governments to ecstasies of fury which has to be a good indicator.

Like the BBC, they’re probably getting it mostly right when lefties suspect them of Establishment tendencies and Conservatives think they’re all Commies.
