So if your smoke is coming thru the vent on my side of the wall into the bedroom of my child with asthma is that trespassing ?

That's an interesting question. I'm not sure if it even is just one wall. My wife's grandfather has a condo like this (two actually) and no sound whatsoever escapes from one unit into another. At least I've never heard any. For all I know it might be two walls with insulation in between, but I don't really know.

In some, perhaps many, cases, existing apartment buildings have been converted (legally) to condos, perhaps without any structural changes.

And I really don't think we should be restricting our discussion just to condos, anyway. Second hand smoke is a problem for many people living in multiple unit housing.

The easy answer, of course, is to simply outlaw all forms of tobacco. After all, we all agree that tobacco is dangerous to our health, right?

Hell, most places can't even put a ban on nicotine laden tobacco "Vape" products that a flavored and packaged to appeal to teens.

San Francisco recently passed such a ban, but not without a huge campaign by the tobacco industry to defeat it, comparing it to the prohibition on alcohol of the 1920's... deplorable...
