If I were on the Board, I would vote to allow smoking within the units. It’s not like cigarettes are illegal. Then again, I’m completely in favor of allowing all private individuals and businesses the ability whether to allow smoking on their premises or not.

More no smoking signs then stop signs, all over this state. You can't even smoke in smoke shops anymore.

But it is a distinction that matters. My apartment isn't mine. I can't sell it. But I can sell my condo.

However, you're right that the discussion about apartments and property rights is an important one. The structure might not be my property, but that doesn't mean I have no property rights there. I would argue that 4th Amendment rights against unreasonable searches extend to renters, but some disagree with that.

But but but it goes next door just like smoking only more so. 

So if they smoke at the exhaust hood fan at the stove then it's ok.

I didn't see this mentioned, so I'll mention it:

We can all agree that smoking tobacco is generally unhealthy
and that smoking around people who don't want to breathe second
hand smoke is generally rude and should probably be avoided.

But my question is this:

Among the people who crusade against cigarettes and second
hand tobacco smoke, I wonder how many of them are in favor
or marijuana smoking, and if marijuana smoking is legal where
they reside, how many of them would expect that they (or others)
should be allowed to smoke it in their home, apartment or condo?
I wonder if some of the loudest anti-tobacco protestors wouldn't
also be some of the loudest protestors against any crackdown
on the use of marijuana in the exact same residential environment.

Just a thought.

Well, I would complain about second hand smoke from both tobacco and pot smokers.

However it's relatively common knowledge that pot smokers don't chain smoke like tobacco smokers. It might be a few puffs off one joint every three or four hours, if that. So it's usually not even close to the same level of indoor air pollution that cigarette smokers can cause.

No, I'd use the same standard for both. If it bugs me, I'll complain.
