"Representatives shall be apportioned among the several States according to their respective numbers counting the whole number of persons in each State, excluding Indians not taxed."



There are clues here to indicate that the persons counted were citizens. The original authorization to perform a census did not include Indians or slaves. They were not considered citizens. The Reps in the House do not represent people form other nations, even if those people live in the US.

That is not true.  In fact, the census of 1860 does include slaves and others not considered citizens.

I am sure that the law meant American citizens. Not illegal aliens. It said at that time not to even count the Indians.

Yes. The Constitution intends that anyone who lives in the United States is a de facto citizen. Recall that the constitution was written at a time when foreign travel was extremely rare at best. The founders would never have imagined that millions of people from another country would live in the United States.

Fewer than seven years after ex-slaves had been granted citizenship in the Fourteenth Amendment, immigration controls were enacted with the Page Act of 1875, banning Chinese women, and the Chinese Exclusion Act of 1882, expanded to all Chinese immigrants.[30]


Various Supreme Court rulings have been made regarding the Constitutional rights of illegal immigrants over the years. In Yick Wo v. Hopkins (1886), the court ruled that under the Fourteenth Amendment, all people, regardless of "race, of color, or of nationality" or "aliens...alleged to be here illegally" have the right to due process and equal protection under the law[31].

A similar ruling of Wong Wing v. US (1896) stated that all persons within the territory of the United States are afforded equal protections under the Fifth Amendment & Sixth Amendment[32]

A 1904 court decision defined any alien as lacking Constitutional rights when not within the United States.[a] Theodore Roosevelt signed the Naturalization Act of 1906, requiring immigrants to learn English in order to become citizens. In the third year of World War I, the Immigration Act of 1917 defined aliens with a long list of undesirables, including most Asians.[33] The U.S. had otherwise nearly open borders until the early 20th century,[34][35][36] with only 1% rejected from 1890–1924, usually because they failed the mental or health exam.[37][38]

The Immigration Act of 1924, signed just a week before Native Americans were granted citizenship, established visa requirements and enacted quotas for immigrants from specific countries, especially targeting Southern and Eastern Europeans,[37] particularly Italians and Jews,[39][40] and effectively prohibited virtually all Asians from immigrating to America.[41] The quotas were eased in the Immigration and Nationality Act of 1952, and a year after the Civil Rights Act of 1964 outlawed discrimination based on national origin,[39] an immigration and nationality act abolished the quota system while establishing other limits. A 1990 act increased the annual immigrant limit to 675,000 per year.
