You would be correct in the absence of any lawsuit against the executive.

A number of parties joined hands in this case to challenge Trump's move to add the citizenship question to the census. The Supreme Court decided to hear the case. As part of the usual legal procedure, the plaintiffs made their case, and then the defense (Trump) made its case. The Supreme Court was not convinced by Trump's case.

I can't imagine why, since it had become obvious the primary intention of the citizenship question was not to determine who is and isn't a citizen, but rather to discourage non-citizens from completing their census forms. This was quite transparent, since a key staff member in the Trump administration was pushing for the question to be added for just that purpose. The motive was purely political: to discourage more apportionment of House seats to states with larger immigrant populations, which states generally lean Democratic in major elections. Trump blew it by concocting a less than credible excuse for adding the question. In fact, it was a cynical attempt that beggared belief: the administration claimed that adding the question would reduce voting rights discrimination, when in reality its effect would be to increase voting rights discrimination. Ludicrous.

Now if you think this is a troll response, you have an extremely limited understanding of how our democracy works, and a defective understanding of what our Constitution says.

Your problem, not ours.

Why would a non-citizen not fill out the censes form? That is if they got one. And what difference does it make if they get one or not? They are not supposed to vote. They have no right to tell us how to run our government. And neither do you and your socialist party. If you are not for America and the successful capitalist way get the hell out of here. We don’t need ignorant people that want to live off the working and successful Americans.

Well, they told the court they needed the question to help enforce the voting rights act. LIE.  They told the court they needed a decision before the end of June.  LIE

Archie, here is the wording of the Census in our constitution:

Representatives and direct Taxes shall be apportioned among the several States which may be included within this Union, according to their respective Numbers, which shall be determined by adding to the whole Number of free Persons, including those bound to Service for a Term of Years, and excluding Indians not taxed, three fifths of all other Persons. The actual Enumeration shall be made within three Years after the first Meeting of the Congress of the United States, and within every subsequent Term of ten Years, in such Manner as they shall by Law direct. The Number of Representatives shall not exceed one for every thirty Thousand, but each State shall have at Least one Representative; and until such enumeration shall be made, the State of New Hampshire shall be entitled to chuse three, Massachusetts eight, Rhode-Island and Providence Plantations one, Connecticut five, New-York six, New Jersey four, Pennsylvania eight, Delaware one, Maryland six, Virginia ten, North Carolina five, South Carolina five, and Georgia three.

Notice that the word 'citizen' is not mentioned. Do you dispute the wisdom of our founders? Because if you do, then don't you dare, EVER, use our constitution to defend one of your ideologies, like gun rights. If they were wrong about the Census, then you are open to them being wrong about anything.

Lulz.

Yeah, who needs rule of law, a constitution, checks and balances, etc. Just let the executive branch do whatever it wants.

See the 14th Amendment, Section 2:

"Representatives shall be apportioned among the several states according to their respective numbers, counting the whole number of persons in each state, excluding Indians not taxed."
